Rules and Regulations
LUTHERAN VALLEY RANCH INC.
Pursuant to Article VII, Section 1, of the by-laws of Lutheran Valley Ranch, Inc., the Lutheran Valley Ranch Board of Directors (hereafter “Ranch Board”) establish these Rules and Regulations for the management, control and administration of Lutheran Valley Ranch, Inc. (hereafter, “LVR”). These Rules and Regulations are binding on all members for their mutual benefit. Violation of these Rules and Regulations can result in a warning, a fine, temporary suspension of membership privileges or a complete expulsion from membership in LVR, at the discretion of the Ranch Board. Repeated or on-going violation of these rules by a guest of a member or by an associate member after the primary member(s) has been notified of such violation in writing shall constitute a violation by the primary member.
Section 1. Land Use
- Only residential and/or camping usage shall be allowed on any LVR lot. Not more than one single family dwelling unit, as defined by Teller County regulations, may be erected on any lot.
- A minimum setback distance of seventy feet from any LVR road or lot boundary is established for the placement or construction of any temporary or permanent structure, camping vehicle or trailer. Upon request made to the Ranch Board stating special or exceptional circumstances, the minimum setback distance may be modified at the discretion of the Ranch Board.
- Every LVR lot shall be kept in a neat and clean condition, particularly the 20 feet adjacent to any LVR road. LVR provides no facilities for trash and garbage disposal. Please remove from LVR premises all trash, garbage or other items that which you wish to dispose of. There shall be no scattering of refuse, trash or garbage on LVR property.
- Healthy, wildfire-defensive forestry is encouraged at LVR. Clear cutting is not permitted other than for building or camping or access thereto. Cutting of diseased trees, or thinning overcrowded trees, or transplanting small trees is permitted. For guidance please contact the Ranch Board.
- All LVR premises shall be maintained in a manner that will help maintain and enhance the natural environment. Mulching and erosion control by the placement of felled dead trees perpendicular to sloped areas is needed and encouraged.
- Permanent sanitation facilities, ie: septic tanks and leach fields, must be built and maintained in accordance with Teller County requirements.
Section 2. Architectural Control
- Written plans (including a site location map) for construction of permanent housing, permanent utility structures, permanent camping structures or other permanent improvements, shall be submitted to the Ranch Board for approval before any construction is started.
- The Ranch Board shall approve or disapprove such plans at the next regular bi-monthly meeting after they are submitted.
- Lot Lessee must obtain necessary Teller County permits prior to start of construction.
- No barrier fences or individual access gates shall be allowed on any LVR premises.
Section 3. Camping Vehicles or Trailers:
- These Section 3 requirements do not apply to camping vehicles or trailers placed on an LVR lot for less than one month.
- Authorization for the placement of any camping vehicle or trailer must be obtained from the Ranch Board before placement of any such camping vehicle or trailer for an intended period of longer than three months. Application for such placement shall be made in written form, and approval obtained, prior to permanent placement of same on any LVR premises.
- The long term placement of camping vehicles and trailers should be situated on the LVR lot to minimize visual impact and blend with the surroundings as much as is practicable. Authorization for the placement of any camping vehicle or trailer on any LVR lot is deemed temporary and may be revoked by the Board upon reasonable notice to the member or owner.
- The placement of any camping vehicle or trailer shall comply with the minimum setback requirement of Section 1 (b), hereof.
- All applicable Teller County building permit requirements shall be complied with, and the necessary approval/permit(s) obtained, before any camping vehicle or trailer is permanently attached or affixed to any LVR lot.
Section 4. Fires
- Campfires and cooking fires shall only be permitted in properly sited and constructed fire pits. All fires shall be thoroughly extinguished before being left unattended. Approved chimney screens shall be installed in all dwelling fireplace chimneys. Ashes shall only be disposed of when cold and in fireproof areas.
- All Teller County open burning, campfire and cooking fire restrictions shall be complied with on all LVR property. The Ranch Board may, at its discretion, restrict open burning, campfire and cooking fires regardless of local jurisdiction rules governing adjacent properties. The Ranch Board will endeavor to place notice of any open burning, campfire or cooking fire restriction on the bulletin board in the ranch house.
- The shooting or igniting of fireworks shall be prohibited on all LVR property.
- The burning of slash piles of brush and tree limbs shall be prohibited on all LVR property, except under the direction of the Ranch Board and only after obtaining the proper fire district permit.
- At least one approved fire extinguisher shall be placed in each camping or dwelling structure.
Section 5. Nuisance
- No noxious or offensive activity shall be permitted upon any LVR property, nor shall any conduct be permitted which may be reasonably deemed an annoyance or nuisance to occupants of neighboring lots.
- Motorized vehicles, including ATVs, motorcycles and snowmobiles shall not be so used as to be a nuisance to the neighborhood.
- All motorized vehicles shall stay on designated LVR roads.
- Every motorized vehicle on LVR property shall abide by the posted 20 MPH speed limit.
- Recreational vehicles such as ATVs, motorcycles, and snowmobiles operated on LVR property shall have a LVR decal prominently displayed on them. Decals will be provided by LVR.
Section 6. Firearms/Hunting
- The discharge of any firearm, including pellet gun and BB gun, is prohibited upon all LVR property. Hunting of any kind, or by any means, is also prohibited on all LVR property.
Section 7. Animals and Pets
- Dogs, cats, other household pets and horses may be kept provided they are not kept, bred, or maintained for any commercial purpose and are so limited in number and so cared for that they shall not constitute an annoyance. No other animals, livestock or poultry of any kind shall be raised, bred or kept on any lot except as herein provided.
- All animals at public areas such as the ranch house, retreat, campgrounds, or lakes, shall be confined, leashed or held.
Section 8. Water
- All surface water in LVR is to be considered “open” water, and shall not be impounded in any way without approval of the Ranch Board.
- All waters stocked with fish, either by LVR or by any individual, may be fished in by all members. No posting of private fishing by individual members shall be allowed.
- The fishing limit is three fish per day per individual, and no more than ten fish per day per membership. Any membership totaling a catch of over 25 fish per year will be expected to contribute $2.50 per fish over the annual limit of 25 to the Fish Fund.
- No watercraft or flotation device shall be left unattended on or adjacent to any LVR lake at any time. COAST GUARD approved life jackets shall be worn by everyone in or on any watercraft or floating device used on LVR property.
- No swimming or wading shall be permitted in any lakes on LVR property.
Section 9. Signs
- No sign of any kind shall be displayed to public view on any lot, except for the use of well designed name signs or plates installed by a member to designate a particular lot or dwelling.
- Directional signs or indicators for a group gathering or party shall be removed immediately after the function terminates.
- A fire number sign shall be posted in a conspicuous location on each LVR lot. This posted number differs from the lot number assigned by LVR. These signs will be provided by LVR.
Section 10. Access Roads
- No roads shall be maintained on any lot except that of the membership owner to a particular dwelling or campsite.
- If any owner of a membership is unable to drive to his or her site because of adverse topography, he/she may gain access through a neighboring lot; provided, however, that such neighbor may designate the placement of such access road, together with the Ranch Board. Easement documents are available through the Ranch Board and shall be signed by both parties. Such easement shall be with the prior approval of the Ranch Board.
- Winter access to all LVR property is not guaranteed. Snow removal efforts will be attempted for Ellison Road, to maintain access to the retreat area. Winter access to individual LVR lots accessed by other established roads within the LVR property will not be plowed by LVR. Snow removal to access an individual LVR lot is the responsibility of the member.
Section 11. Ranch House
- All ranch members are responsible for the cleanliness of the ranch house, and they are required to adhere to the directives posted therein. Trash generated by individual use shall be removed by the user.
- Reservations for use by a group of individuals shall be made by contacting the Ranch Board. The cost for this type of use is $50 per day, and payment is to be mailed to the LVR post office box and addressed to the attention of the Treasurer.
- Reservation of the ranch house will not restrict access to the rest rooms etc. by other members of LVR.
Section 12. Members and Guests
- Every LVR member having guests in LVR shall be responsible for the conduct of their guests. These Rules, and others posted, in LVR will be observed by all LVR members and guests.
- While at LVR, members shall wear their membership buttons.
- While at LVR, guests of members shall wear guest buttons (generally available upon request from the Ranch Board) that clearly indicate of which membership they are guests.
Section 13. Termination of Membership
- Upon termination of a full membership, for any reason except by death of the member, usage rights of the applicable membership lot reverts back to LVR and is under the control of the Ranch Board and subject to re-issuance to those in priority on the waiting list.
- A member may add the name or names of any family members to his membership, provided such person or persons meet the qualifications of membership as set forth in the LVR by-laws. Any name or names may be deleted from a membership with the consent of all concerned. For any addition or deletion of names to the membership, there will be a charge of $25.00, payable to Lutheran Valley Ranch, Inc.
- If a membership is listed in the name of more than one person, and through divorce or other court action, the name of one or more persons is to be deleted from the membership, a letter of resignation shall be provided to LVR by the person being deleted. If such is not done, a copy of the applicable order of the court shall be submitted to LVR for placement in the files of LVR as proof of ownership of that membership.
Section 14. Membership Application, Lot Selection Process, Lot Transfers by Members
- The Ranch Board will maintain a list of: Usage lots available for assignment (Lot Availability List); a waiting list of new potential members who have not been assigned a usage lot ([1] New Member List); and a list of existing members wishing to change usage lots ([2]Lot Transfer List).
- New Members
- The Ranch Board will determine priority on the New Member List by the Post Office cancellation date shown on the application form envelope.
- A potential member shall make written application to the Ranch Board, per Article II Section 8 of the LVR By-Laws.
- The potential member will be added to the New Member List.
- When a lot becomes available the new potential member on the top of the New Member List will be notified what lot(s) is(are) available.
- The new potential member is then requested to send in their application fee ($2,500) plus the current year’s assessment ($555 if application is approved in September thru January or $277.50 if application is approved in February thru August) and their lot selection (if more than 1 lot is available).
- Once the application fee and current years assessment are received, the Ranch Board will review the written application and determine if the applicant will be granted a membership pursuant to the LVR By-Laws.
- The Ranch Board will subsequently assign a usage lot to the new member if they were approved for membership, giving priority amongst several applicants to the earlier post office cancellation date.
- A new member welcome packet including a welcome letter, certificate, badges, driving safety tips, car window clings and ATV sticker will be sent to the new member.
- A name lot sign will be made and put up on the lot.
- Lot Transfer
- Existing LVR members wishing to change lots will notify the Membership Secretary on the Ranch Board that they wish to change lots. The Membership Secretary then adds them to the bottom of the Lot Transfer List. An existing LVR member who has previously been assigned a lot will be given a priority selection of usage lots over new potential members who have not been assigned a lot. Request will be processed by the order of the list. A $25 lot transfer processing fee is due prior to the transfer being completed.
- Sale of Improvements on lots.
- It is the responsibility of lot members to sell the improvements on their lots following the rules set forth below.
- The Lutheran Valley Ranch Board of Directors shall be the first ones notified that there are improvements on a lot to be sold.
- The Board member in charge of the email list for Ranch will contact members on email list that the improvements on a lot are for sale and to contact the improvements owner.
- If the improvements are still not sold, they will be offered to new potential members on the New Member List in the order they are on the waiting list.
- If the improvements were sold to current members the Ranch Board will be notified and a $25 lot transfer processing fee will be paid.
- If the improvements were sold to someone on the New Member List, the potential new member is then requested to send in their application fee plus the current year’s non-prorated assessment. The process of steps f thru i under New Member will then be followed.
- All memberships shall receive a single yearly assessment in accordance with the by-laws, and at the rate established at the preceding annual membership meeting.
- Annual membership fees and delinquent debts shall be due and payable on December 1st of each year. If payment of a member’s annual membership fee and any unpaid delinquent debts is not received by December 1st of the year in which it is due, the member will be notified by mail and be given 60 days to forward payment, including a late fee. If such payment is not received within that 60 day time period, the membership shall be brought before the Ranch Board, to be evaluated and considered for termination of membership by forfeiture. This will be done in accordance with the by-laws under Article II, Section 11. Delinquent debts shall mean and include: unpaid membership fees, charges, fines, dues and/or assessments which are in arrears. Delinquent debts shall draw interest at the rate of ten per cent per annum if not paid within one year.
- If any member is delinquent in his taxes to Teller County, Colorado, for any improvements on his membership lot, the Ranch Board, at their option, may authorize the Treasurer of LVR to pay such delinquent taxes, and such sum shall be assessed as a delinquent debt to LVR. This debt will be addressed in accordance with Section 15, paragraph a., above.
- All Ranch members shall behave in a courteous and respectful manner toward all Retreat staff, Retreat guests and Retreat property while present upon the Retreat’s property;
- All Ranch members who operate any vehicle (including an OHV) upon the Retreat’s property shall do so in a safe and courteous manner, including:
- Operating at speeds no greater than 20 MPH (or less within the presence of structures, horses and pedestrians) and shall refrain from the intentional spinning of vehicle tire(s) and/or sliding/drifting their vehicle around any curve or corner; and,
- Maintain a visible Ranch member windshield window cling upon any car, trucks or SUV, or a bright yellow Ranch member OHV sticker upon any OHV.
- No Ranch member shall photograph or take any video recording of any Retreat staff, Retreat guest, or of any Retreat structure or improvement without first obtaining prior written consent to do so from the Retreat.
- All Ranch members who enter upon the Retreat’s non-roadway property shall be subject to compliance with the Retreat’s published Guest/Visitor Rules of Conduct. Any Ranch member who intentionally violates any provision of the Retreat’s published Guest/Visitor Rules of Conduct shall be deemed to be in violation of this
- Any Ranch member who engages in inappropriate behavior while upon the Retreat’s property shall immediately leave the Retreat’s property (including the shared roadway situated upon the Retreat’s property) if asked to do so by Retreat staff. Any Ranch member who fails to promptly comply with such a Retreat staff request to leave shall be deemed to be in violation of this
- The primary and/or associate Ranch membership holder(s) shall be held equally responsible and accountable for the conduct of their guest(s) and other family members for purposes of these Roadway Sharing Rules of
- A warning (oral or written);
- A fine and/or Ranch membership penalty assessment of up to, but not exceeding $100.00; and/or,
- Suspension (temporary or permanent) of all privileges to use the shared roadway situated upon the Retreat’s
- The Ranch Board of Directors shall be the sole judge for determination of a violation of these Roadway Sharing Rules of Conduct, as well as any fine and/or Ranch membership penalty assessment to be
- The final determination of a violation of these Roadway Sharing Rules of Conduct, and the penalty to be imposed, may be made by the Ranch Board at any regular or special meeting of the Ranch Board by a majority vote of the Ranch Board members present at such meeting (but not at the Ranch Annual Meeting).
- At least 20 days prior to such regular or special Ranch Board meeting where a determination of a violation of these Roadway Sharing Rules of Conduct is to be considered by the Ranch Board, written notice of the Ranch Board’s intention to make a violation or penalty determination shall be mailed to the affected Ranch member(s) at his or her last known
- Any affected Ranch member shall be provided with an opportunity to appear at that Ranch Board meeting and provide an explanation for the conduct in question and to present any mitigating circumstances to the Ranch

Section 17. Roadway Sharing Rules (while on Retreat Property).
History: In 1969, LV Ranch Inc. (hereafter ‘Ranch’) deeded the northern 240 acres of its original parcel to LV Retreat, Inc. (hereafter ‘Retreat’). All Ranch rules existing prior to the 1969 property transfer became no longer applicable to the Retreat property. At that same period in time, the Ranch and the Retreat entered into a roadway sharing agreement concerning the mutual use of Ellison Road and Beaver Valley Drive. The roadway sharing agreement does not authorize any Ranch member to depart from or leave the shared roadway onto any Retreat non- roadway property.
Purpose of these rules: To ensure the appropriate conduct and behavior of all Ranch members who use the shared roadway to enter the Retreat’s property, and to also make it clear to all Ranch members that the roadway sharing agreement does not confer any right on any Ranch member to enter upon the Retreat’s non-roadway property.

Determination of Violation and Penalty:
No provision within this Section 17 shall be construed or interpreted so as to modify, or limit, the Ranch Board’s authority to expel or suspend a Ranch member under Article II, Section 11(d) of the Ranch Bylaws.
